Acceptance of Terms

These Terms and Conditions ("Terms") govern your use of Humufy's services and website. By accessing or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not access or use our services.

These Terms of Service (“Terms”) describe your rights and responsibilities when using the mobile and/or web-based software platform, application programming interface and associated software, and other related services (the “Services”) offered by Humufy(“we”, “our”, or “us”). If you are a Customer, these Terms govern your access and use of our Services. These Terms (or, if applicable, your written agreement with us) and any Order Form(s) together with all documents referenced herein form the “Agreement” between Customer and us.

1. Acceptance of Terms

   By using Humufy's services, you agree to comply with these Terms. If you do not agree to these Terms, you may not use our services.

2. Description of Services

   Humufy provides generative AI-based product shot creation services. Users can upload images or input parameters to generate product shots using our AI models.

3. Data Collection and Usage

   Users acknowledge and agree that Humufy may collect and use data generated by their usage of our services to improve and train our AI models. This data may include but is not limited to images, parameters, and user interactions. Humufy will handle this data in accordance with its Privacy Policy.

4. User Responsibilities

   Users are responsible for the content they upload or generate using Humufy's services. Users must not upload or generate content that is illegal, promotes nudity, infringes upon the rights of others, or violates these Terms.

5. Intellectual Property

   All content generated by Humufy's services, including but not limited to product shots, images, and AI models, are the intellectual property of Humufy. Users retain ownership of the content they upload, but grant Humufy a license to use, modify such content for the purpose of providing and improving our services.

6. Limitation of Liability

   Humufy shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with the use of our services. This includes, but is not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses.

7. Cancellation of Subscription

   You can cancel your subscription at any time . Your cancellation will take effect at the end of the current paid term.

8. Prohibited Activities

   Your use of the Site is subject to the following restrictions: You may only use the Site for its intended purpose as provided by us, and it must not be utilized for any commercial purposes unless expressly permitted by us.

   As a user of the Site, you agree not to:

   • Collect data or content from the Site to create databases or directories without our written permission.
   • Attempt to deceive or obtain sensitive account information from us or other users.
   • Interfere with security features of the Site.
   • Disparage, tarnish, or otherwise harm our reputation or the Site's reputation.
   • Use information from the Site to harass, abuse, or harm others.
   • Make improper use of our support services or submit false reports of abuse or misconduct.
   • Use the Site in a manner inconsistent with any applicable laws or regulations.
   • Engage in unauthorized framing of or linking to the Site.

   • Delete the copyright or other proprietary rights notice from any Content.

   • Upload or transmit any material that acts as a passive or active information collection or transmission mechanism.
   • Interfere with, disrupt, or create an undue burden on the Site or its networks.
   • Harass, annoy, intimidate, or threaten any of our employees or agents.
   • Attempt to bypass any measures designed to prevent or restrict access to the Site.
   • Copy or adapt the Site's software without authorization.
   • Decipher, decompile, disassemble, or reverse engineer any of the Site's software.
   • Use, launch, develop, or distribute any automated system without authorization.
   • Use a buying agent or purchasing agent to make purchases on the Site.
   • Make any unauthorized use of the Site, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretenses.
   • Use the Site as part of any effort to compete with us or otherwise use the Site and/or the Content for any revenue-generating endeavor or commercial enterprise.

9. Changes to Terms

   Humufy reserves the right to modify or revise these Terms at any time. Users will be notified of any changes to these Terms, and continued use of our services after such changes constitutes acceptance of the modified Terms.

10. Governing Law

    These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
